The Madrega mobile application and the website madrega.app (together, the "Service") are provided by Ruslan Abdrakhmanov, a self-employed individual (autónomo) registered in Spain, with address at Carrer de Reig i Bonet 5, 08024 Barcelona, Spain ("Madrega", "we", "us"). Tax Identification Number (NIF): provided upon request for legitimate legal or contractual purposes. 2. Acceptance
These Terms of Use (the "Terms") govern the use of the Service. By creating an account you confirm that you have read and accept these Terms and that you have read the Privacy Policy. If you do not accept these Terms, you must not use the Service.
3. Nature of the Service
The Service is provided free of charge. It contains no subscriptions, in-app purchases or advertising. The Service offers guidance for the gradual observance of Jewish religious practice according to the Chabad tradition, including prayer texts, reminders, holiday information and an AI mentor.
4. Eligibility
The Service is intended for persons aged 16 or over. By creating an account you represent that you are at least 16 years of age.
5. Account
An account is required to use the Service. You must provide accurate information and keep your password confidential. You are responsible for all activity carried out through your account. You must notify us without undue delay at support@madrega.app of any unauthorised use of your account. You may delete your account at any time in Settings.
6. Licence
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable and free-of-charge licence to use the Service on devices that you own or control, for your personal and non-commercial purposes.
7. Acceptable use
You must not: (a) copy, modify, distribute, sell or lease any part of the Service; (b) decompile, disassemble or reverse engineer the application, except to the extent permitted by mandatory law; (c) extract data from the Service by automated means, including scripts, scrapers or bots; (d) circumvent or interfere with any security or access-control measure; (e) access the Service or our servers by any means other than the interfaces we provide; (f) use the Service to harass, threaten, defame or discriminate against any person or group, or to collect information about other users; (g) use the Service in breach of any applicable law.
8. AI mentor
The answers of the mentor and of the support assistant are generated by artificial intelligence. You are informed that you are interacting with an AI system and not with a natural person. The answers are based on Chabad sources but may contain errors and do not constitute rabbinical rulings or medical, psychological, legal or financial advice. For personal halachic questions, consult a qualified rabbi.
9. User content and moderation
You may publish wishes addressed to other users and send messages through the Service ("User Content"). User Content must comply with section 7 and must not contain hateful, insulting, discriminatory, promotional or unlawful material or personal data of third parties. Every wish is reviewed before publication by an automated filter followed by a human decision. We may refuse to publish or remove User Content that infringes these Terms or applicable law, and may suspend or terminate an account in the event of serious or repeated infringements. Where we restrict User Content or an account, we will inform you of the decision and its reasons, unless prohibited by law, in accordance with Article 17 of Regulation (EU) 2022/2065 (Digital Services Act).
10. Notices of illegal content
Any person may notify us of content in the Service that they consider illegal by writing to support@madrega.app, stating the reasons, the exact location of the content, their name and email address, and a statement that the notice is made in good faith. We will process notices diligently and objectively and will inform the notifier of our decision. The single point of contact for authorities and users under Articles 11 and 12 of the Digital Services Act is support@madrega.app. Communications may be made in English, Spanish or Russian.
11. Licence to User Content
You retain all rights in your User Content. By publishing a wish you grant Madrega a non-exclusive, worldwide, free-of-charge licence to host, display it to other users of the Service and translate it into the languages of the Service, for as long as the wish remains published. The licence ends when you delete the wish or your account.
12. Intellectual property
The Hebrew liturgical texts are in the public domain. Translations, transliterations, explanations, stories, illustrations, audio recordings, software and design of the Service are owned by Madrega or used under the licenses listed in the Notice of Sources and Licenses. Except for the licence granted in section 6, no rights are transferred to you.
13. App stores
The application is distributed through the Apple App Store and Google Play, whose terms also apply. If you use the application on an Apple device, the Licensed Application End User License Agreement of Apple applies in addition to these Terms, and: (a) these Terms are concluded between you and Madrega only, not with Apple; (b) Apple has no obligation to provide maintenance or support for the application; (c) Apple is not responsible for any claims relating to the application, including product liability claims, claims of non-conformity with legal or regulatory requirements, consumer protection claims or claims of intellectual property infringement; (d) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
14. Conformity and accuracy
We take reasonable care to ensure the accuracy of prayer texts, candle-lighting and other times, and holiday dates. Times are calculated from the location you provide and may differ from those of your local community. In matters of religious observance, follow the instructions of your rabbi. Where you are a consumer, the legal guarantee of conformity for digital content and services under the Spanish General Law for the Defence of Consumers and Users (Royal Legislative Decree 1/2007, TRLGDCU) applies. To exercise it, write to support@madrega.app.
15. Liability
Madrega is liable without limitation for damage caused intentionally or through gross negligence, and for death or personal injury. In all other cases, and to the extent permitted by law, Madrega is not liable for indirect or consequential damage, loss of data that you could have avoided by ordinary precautions, or interruptions of the Service caused by events beyond its reasonable control. Nothing in these Terms limits the rights you have as a consumer under mandatory law.
16. Availability and changes to the Service
We may modify, suspend or discontinue features of the Service. If we decide to discontinue the Service as a whole, we will notify you in the application at least 30 days in advance and enable you to export your data during that period.
17. Termination
You may terminate the contract at any time and without cost by deleting your account. This also covers any statutory right of withdrawal. We may terminate the contract with 30 days' notice, or with immediate effect in the event of a serious or repeated breach of these Terms, by informing you of the reasons.
18. Changes to these Terms
We may amend these Terms for legitimate reasons, such as changes in the law or in the Service. We will notify you of material changes in the application at least 30 days before they take effect. If you do not agree to the changes, you may delete your account before they take effect. Continued use after that date constitutes acceptance of the amended Terms.
19. Governing law and jurisdiction
These Terms are governed by Spanish law. If you are a consumer habitually resident in another Member State of the European Union, you also enjoy the protection of the mandatory provisions of the law of your country of residence. Any dispute shall be submitted to the courts of your domicile where you act as a consumer.
20. Miscellaneous
If any provision of these Terms is held invalid, the remaining provisions shall remain in force. Failure to enforce any right does not constitute a waiver of it. You may not assign your rights under these Terms without our consent.
21. Language
These Terms are drafted in English. Translations are provided for convenience. In the event of any discrepancy between the English version and a translation, the English version shall prevail, without prejudice to the mandatory consumer protection rules of your country of residence.
